Macomb, Oakland & Wayne County Criminal Defense Attorney
Criminal Law is not for Amateurs. I am an Expert, and have been working almost exclusively in the criminal law field for 28 years. I have a 92% win record based on over 2000 cases, and more than 500 jury trials.
In the defense of clients charged with crimes, from Murder to Domestic Violence, I have a reputation for aggressive defense and the use of every legal, technical and persuasive resource to succeed in getting for them the best possible outcome.
The following advice is based on those 29 years of experience and that expertise.
I) DO NOT TALK TO THE POLICE BEFORE YOU TALK TO A LAWYER
I maintain a 24 hour, seven day a week phone connection [(248)–,584–4700] and can be reached any time. There is not charge for a telephone consultation.
2) YOU MUST SAY TO THE POLICE “I WANT TO SPEAK TO A LAWYER”
A United States Supreme Court Decision arising from a case here in Michigan has held that unless you explicitly say you want a lawyer, you may end up having waived your constitutional protection without having realized it.
3) THE UNITED STATES SUPREME COURT SAYS THE POLICE ARE ALLOWED TO LIE TO YOU! I mean it. And they do so all the time. The most common lie is that if you cooperate with them they will get you a good deal with the prosecutor. The same Supreme Court says that the police cannot make a deal that is binding on the prosecutor. Don’t talk to the police until you have talked to me!
4) DO NOT SIGN ANYTHING EXCEPT A FINGER PRINT CARD AND A RECEIPT FOR YOUR PROPERTY
The police will routinely give people a form variously called an “Advice of Rights Form”, a “Waiver of Rights Form”, a “Miranda Warning Form.” People are told to just put there initials on it, or their signature on it just to show that the police are doing their job by warning you about your rights. They may tell you that the court requires that you sign it. DON’T SIGN IT. See item 3 above.
5. IF YOU ARE PUT IN A CELL WITH OTHER PRISONERS DO NOT ANSWER ANY QUESTIONS ABOUT YOUR CASE
Do not even tell these people what you are charged with. Tell them that you have a very good lawyer and he says you are only to talk about sports and the weather.
This is just the surface of what you must know, but it is critical to follow this advice. Someone once said that the worst lawyer in the world who gets his client to shut up, does more good for that client than Clarence Darrow will do for him 10 minuets after he has made an incriminating statement to the police.
